By accessing or using the Bring On The Leads (BOTL) platform, operated by 95Visual, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use our services.
2. Description of service
BOTL provides a managed CRM and marketing automation platform that includes lead capture, automated follow-up, sales pipelines, email marketing, SMS marketing, appointment scheduling, and reputation management. We also provide setup, configuration, and ongoing support as part of our service.
3. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Acceptable use
You agree not to use our services to:
- Send unsolicited commercial email or SMS messages in violation of applicable laws
- Violate any law, regulation, or third-party right
- Infringe on any intellectual property rights
- Distribute malware, viruses, or other harmful code
- Attempt to gain unauthorized access to any part of the service
- Use the service to send communications to recipients who have not consented to receive them
5. SMS and messaging compliance
You are responsible for ensuring that your use of SMS, email, and other messaging features complies with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and carrier guidelines. 6. Billing and payment
Subscription fees are billed on a recurring basis as described on our pricing page. Usage-based charges (such as SMS, email, and AI processing) are billed separately based on actual usage. You are responsible for all charges incurred under your account.
7. Data ownership
You own your contact data, including contacts, deals, conversations, and custom fields. You may export your data at any time. BOTL retains the right to use aggregated, anonymized data for analytics and service improvement.
8. Service availability
We strive to maintain high availability but do not guarantee uninterrupted access to our services. We may perform maintenance, updates, or changes that temporarily affect availability. We are not liable for any downtime or service interruptions.
9. Limitation of liability
To the maximum extent permitted by law, BOTL and 95Visual shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the service.
10. Termination
You may cancel your account at any time. We may suspend or terminate your access to the service if you violate these terms or if your account is inactive for an extended period.
11. Changes to these terms
We may update these Terms of Service from time to time. We will notify you of significant changes by posting the updated terms on this page and updating the "Last updated" date.
